Activity 4.8 - Charging document fill-in

Task

Now you are going to practise completing the front page of a charging document as if you were a police officer. This is one of the two ways a matter comes to court. (The proper term is 'commenced'). An enforcement officer, nearly always a police officer, completes a charging document and files it in court. It may be taken to court in person, or emailed (in some areas).

(Remember that the other way a matter is commenced is when a person has chosen not to pay their ticket (infringement notice) and has requested a hearing. If that occurs, the agency files a notice of hearing, not a charging document. See section 21 Summary Proceedings Act 1957, and activity 2.4).
  1. Open the charging document and the fact scenario, save them to your computer and then complete the activity. You can either save the files (with your answers) or print them.
  2. Fill in the front of the charging document according to the fact scenario.
  3. When you are finished, check the answers.
  4. Note: You are only completing the front page of the Charging Document. You are not required to complete the Record of Hearing.
