Taking Declarations
Chapter seven covers taking statutory declarations under the Oaths and Declarations Act 1957. It is worth learning the required wording of a statutory declaration off by heart, as well as the declaration question you will ask declarants – on page 40 of the manual, point 5.
Many other statutes (Acts) allow for a government department chief executive (or equivalent) to authorise wording on forms. In this case the wording of a declaration on a form might be different from that prescribed by the Oaths and Declarations Act. It is still a ‘statutory’ declaration but you do not necessarily take the declaration in the way prescribed for a declaration under the Oaths and Declarations Act. However it is always important that the person declares or acknowledges aloud that the declaration is theirs and that it is true.
